DEFINITIONS

  • “IWD” means Integral Web Design and/or any affiliate which shall supply Services to you.
  • “TOP” means Terms of Payments (this document) and everything it contains
  • “Services” collectively means what we provide to you and the purchasing of our services
  • “Products” collectively means what we provide to you and the purchasing of our products
  • “We,” “us” or “our” means Integral Web Design.
  • “You” and “your” mean the person, firm or company who purchases Services from Integral Web Design.
  • “Web Design” and “website” means every aspect of the website (coding, design, modifications, templates, content, pictures, images, text, functionality, illustrations) designed or handled by Integral Web Design.
  • “Graphic Design” means every aspect of the graphic design (concepts, illustrations, templates, samples, images, pictures, text) designed or handled by Integral Web Design.

 

Payments

1.1.  We want to ensure you have many payment options, so we allow you to make payments using a number of different forms of payment methods with only the inclusion of third party entities for online payments and purchasing.

 

1.2.  All payments must be made within 30 days of invoice. If a payment is not made within these 30 days, IWD reserves the right to remove or edit any form of the product or service provided to you that this payment is due for. If for some reason said product or service is duplicated and / or reused or produced, this act would be deemed theft and illegal as the Web Design or Graphic Design service is property of IWD.

 

1.3.  Any and all products and services unpaid for belongs to IWD and we reserve the right to use, disclose, display, create derivative works of, distribute, transmit, prevent usage of, retract, destroy and reproduce any item from any unpaid product or service.

 

1.4.  We often offer ‘Special Offers’ such as discounts. These promotions or offers have specific Terms of Service and do not apply to applicants who are not using them.

 

1.5.  All sales are final, so DO NOT commit to a transaction unless you are ready to pay.

 

1.6.  WE MAKE NO WARRENTIES OF ANY KIND WITH REGARDS TO ANY PRODUCT OR SERVICES SOLD ON OR THROUGH IWD

 

Deposits

2.1.  We charge a 30% deposit before any work is started. This is a non refundable charge.

 

2.2.  The 30% deposit can be ONLY compensated under specific conditions authorized by a representative of IWD.

 

Refunds

3.1.  Refunds are not applicable at any time before, during or after the Web Design Process or Graphic Design Process unless a special circumstance occurs that permits a representative of IWD to do so.

 

3.2.  Without limiting section 3.1, one such fixed ‘special circumstance’ is the order of a product or service before it becomes available or can be provided to you. In this event, a refund is applicable.

 

Payment Cancellation and Changes

4.1.  We reserve the right to terminate a particular order or aspect of any product or service at anytime during the development or design process if we believe the transaction violates these Terms of Payment or we believe doing so my prevent financial loss.

 

4.2.  You also reserve the right to terminate a particular order or aspect of any product or service at anytime during the development or design process; however, we reserve the right to charge you a fee which is dependent on the work done during these processes.

 

4.3.  Prices of products or services provided by us are subject to change at any time during or before the design and development process of any Web Design or Graphic Design with the inclusion of additional tasks, products, services, designs or development. This price change will be reflected in the final pricing for the product or service provided.

 

4.4.  We may place a delay on a payment for a period of time, limit payment sources for a transaction, and limit your ability to make a payment if we believe doing so may prevent financial loss.

 

4.5.  We may contact your payment source issuer, law enforcement, or impacted third parties and share details of any payments you are associated with if we believe doing so may prevent financial loss or a violation of law

 

4.6.  If you believe there is an error in your invoice you must contact us in writing and we can each agree to work together in good faith to resolve any billing disputes. The dispute must include sufficient facts for us to investigate the claims which must be received by us one week prior to the Due date.

 

Payment Types

5.1.  When you confirm a transaction with IWD whether it be via an online, cheque or cash payment, you agree to be bound by and pay for that transaction.

 

5.2.  In the event that a payment is made to the incorrect party, we can each agree to work together in good faith to resolve the payment dispute and provide facts that lead to the source of the problem. The party who is the responsible is liable to correct the problem and ensure the transaction is resolved.

Payments via:

Online Third Parties

5.3.1.  All payments received online via third parties are subject to these Terms of Payment and also to the Terms of Payments present on the third party’s website.

 

5.3.2.  The responsibility held for the secure transfer of funds over the internet is that of the third party and IWD takes no liability for it.

Cheque or CIH (cash-in-hand)

5.3.3.  Payments received via the said methods are only applicable if received from a representative from IWD who has previously agreed to collect it at a specific time and place. This representative MUST display a form of ID, if not; IWD reserves the right to request this payment again and consider it unpaid.

Bank Transfer

5.3.4.  All payments may via bank transfer are unpaid until the money is present in the bank account it’s sent to. IWD reserves the right to halt, prevent and initialize all actions that may result from the payment until it is made in full.

 

Terms of Payment Amendments

6.1.  We may make changes to the Terms of Payment at any time. Changes made to the Terms of Service will be uploaded and made available at http://www.integralwebdesign.co.uk/terms-of-payment.html.

 

6.2.  You agree and understand that the usage of any service or access to the website on the date with which the Terms of Payment service has change will be treated and accepted that you comply to the edited or additional Terms.

 

Other

7.1.  If you are under the age of 18, you may make payments only with the involvement of a parent or guardian. You should review these Payments Terms with a parent or guardian to make sure that you both understand them.

 

7.2.  All of the commitments you make in the Terms of Service apply to payments through Integral Web Design. In the event of any conflict with relation to payments between these Terms of Payments and the Terms of Service, the Terms of Payments shall prevail.
